Delhi HC holds that death during official tour may not necessarily make the employer liable to pay compensation

Delhi High Court: A Single Judge Bench of the Delhi High Court rejected an appellant’s application for compensation for her husband’s death in his hotel room due to a heart attack while on an official tour.

The deceased had completed his official work by 7:30 pm on the day of his death and had left the workplace. The deceased then had dinner at 7:45 pm and while watching TV at 10:00 pm suffered a heart attack which caused his death. The issue before the Court was whether his death could be said to have taken place during the course of his employment.

The Court, after analyzing the issue carefully noted that there was no evidence which pointed that any stress or strain was involved in the deceased’s work or that the heart attack was a result of the nature of his job.
