Delhi HC asks for the removal of posts pertaining to the confidential business data of “ANI Technologies”

Delhi High Court: A Single Judge bench comprising of Justice Jayant Nath, J., addressed an application placed under Order 39 Rule 1 and 2 CPC seeking a decree of permanent and mandatory injunction against the defendants for the removal of posts disclosing confidential business data of the plaintiff.

The present application on part of the plaintiff was filed against the defendant Company. The defendant Company was alleged of posting content containing confidential information and disparaging comments against the plaintiffs.

The Court observed that on perusal of the documents on record it was evident that the contents and documents as stated above do reveal some confidential business information of the plaintiff which are disparaging to the plaintiff and its employees.

Therefore, the High Court held that Defendant 1 would remove the information as has been uploaded in the app on receipt of a certificate from the plaintiff certifying the information contained in the app as confidential business information or disparaging.
