[Glow & Handsome] | Trademark Suit | Bom HC dismisses Emami’s appeal against Single Judge’s ad-interim order

Bombay High Court: A Division Bench of R.D. Dhanuka and V.G. Bisht, JJ., dismissed “Emami’s” appeal against the ad-interim order passed by the Single Judge Bench of this Court on 6-07-2020, wherein the following was held,

Emami before initiating any legal proceedings shall give 7 days prior notice to Hindustan Unilever Limited.

In the said, Interim Order, Single Judge had granted liberty to Emami to apply for variation of the said order with 48 hours prior notice to Hindustan Unilever’s advocate.

Adding to above, Single Judge had also directed to place the interim application for further reliefs on 27-07-2020.

Thus, in view of the above, bench dismissed the present application. [Emami v. HUL, 2020 SCC OnLine Bom 802 , decided on 16-07-2020]

As reported by economic times,

“While challenging the ruling of the single bench on Thursday, Emami also approached the Calcutta High Court to restrain Hindustan Unilever from using the trademark ‘Glow & Handsome.’ Emami said it had launched the trademark ‘Glow and Handsome’ before Hindustan Unilever announced changes to the names of its products.”
