On February 4, 2021, Arizona Civil Rights Act (ACRA) has been modified through House Bill 2045 in order to expand protections for pregnant workers under Arizona law.
The Amendment modifies Arizona Revised Statutes (A.R.S.) § 41-1461 to specify that prohibited discrimination “‘because of sex’ and ‘on the basis of sex’ includes because of or on the basis of pregnancy or childbirth or related medical conditions.” Additionally, the Amendment expressly provides that “women who are affected by pregnancy or childbirth or related medical conditions shall be treated the same for all employment-related purposes, including receipt of benefits under fringe benefit programs, as other persons not so affected but similar in their ability or inability to work.”
The law is expected to take effect on or about July 19, 2021.
