The Government of Chhattisgarh has passed the Chhattisgarh Electricity Duty (Sanshodhan) Act, 2021 on June 2, 2021. It further amends the Chhattisgarh Electricity Duty Act, 1949 in the following manner:
- In Section 5 of the Chhattisgarh Electricity Duty Act, 1949, sub-section (3) has been inserted:
“(3) Notwithstanding anything contained in the Act, Chief Electrical Inspector, in the exercise of its power and performance of its function under this Act shall issue direction to any person, officer or authority to disconnect from electric line, any such electricity generating station, against which payments of electricity duty and amounts of interest imposed thereon is due and such person, officer or authority shall be bound to comply with such directions.
Explanation :-
(1) For the purpose of this Section, ‘Act’ means Chhattisgarh Electricity Duty Act, 1949 (No. X of 1949).
(2) “Chief Electricity Inspector” shall have the same meaning as defined under sub-section (21) of Section (2) of the Electricity Act, 2003 (No. 36 of 2003).
(3) “Generating station”, shall have the same meaning as defined under subsection (30) of Section 2 of the Electricity Act, 2003 (No. 36 of 2003).
(4) “Electric line” shall have the same meaning as defined under sub-section (20) of Section 2 of the Electricity Act, 2003 (No. 36 of 2003).”
