On August 20, 2021, the Danish Data Protection Authority has released an overview of rules, regulations and obligations which the data controllers must be aware of when using bodycams. The Data Protection Authority has outlined the basic requirements for processing personal data in relation to bodycams which includes:
- If one records images and sound using body-worn cameras (bodycams), one shall be subjected to the general data protection law rules and principles.
- The processing of personal data using body-worn cameras (bodycams) can only take place if the basic processing principles of e.g., legality, reasonableness and transparency, purpose limitation as well as storage limitation are met.
- The Rules provide instructions for employees wearing body cameras, observing the duty to provide information and deleting the recordings.
- The Rules also provide some more detail in relation to the duty to provide information and deleting images and sound recordings from bodycams.
