On January 25, 2022, the Government of Ireland has introduced the <\/span><\/span>Right to Request Remote Work Bill 2021 to provide employees with a statutory right to make, or to have made on their behalf, a request <\/span>for Remote Working. <\/span><\/span><\/p>\n

Key points:<\/p>\n

\n
• An employee shall be entitled to<\/span> submit a request for<\/span> r<\/span>emote <\/span>working<\/span> when the employee concerned has completed<\/span> at least<\/span> 26 weeks<\/span> continuous service with the <\/span>employer from whose employment the<\/span> employee is seeking the arrangement to work remotely<\/span>.<\/span><\/span><\/li>\n
• An employee will<\/span> not be able to submit constant requests and that where the <\/span>employer has diligently completed the assessment process and any appeal <\/span>has been heard that the employee will have to wait a period of<\/span> 12<\/span> months to submit another <\/span>reque<\/span>st. It is not the intention that such a request would be prohibited where an employee has moved <\/span>to a different role within the same employer.<\/span><\/span><\/li>\n
• Provide a balanced mechanism by which<\/span> eligible <\/span>workers can<\/span> request a remote working arrangement<\/span>. <\/span><\/span><\/span><\/li>\n
• An employer having consulted<\/span> the employee and\/or the trade <\/span>union (if<\/span> recognised by the employer<\/span>) of which he or she is a member, return a decision indicating <\/span>whether the request for remote working is wholly or partially approved or declined.<\/span><\/span>

• An<\/span> employer shall,<\/span> having<\/span> concluded their<\/span> consideration of the request<\/span> and having consulted <\/span>the employee or the trade union (if<\/span> re<\/span>cognised by the employer<\/span>) of which he or she is a member<\/span>, <\/span>confirm<\/span> in writing<\/span> if they are<\/span> agreeing to<\/span> the request.<\/span><\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"
