Rajasthan High Court: A Single Judge Bench of Arun Bhansali, J., allowed a petition seeking another opportunity at an examination on the ground of improper conduction of the examination.
The dispute herein was very simple, the petitioner wanted another opportunity at a Physical Examination Test where, according to him, he was subjected to improper conditions which hampered his performance.
The counsel for the petitioner Mr Naresh Kumar Prajapat relied on the case of Revant Ram Meghwal v. State of Rajasthan, SBCWP No. 13731 of 2018, wherein a Physical Examination Test was conducted. The petitioner appeared for the exam. His contention was that the track was slippery and thus should be given another opportunity. The positive determination was made in this regard. The result of PET was quashed and the petitioner was granted one more opportunity to undergo PET.
The High Court followed the said case as both the cases had similar facts. The writ petition was allowed and respondents were directed to hold fresh PET for the petitioner. [Anil Kumar Jedia v. State Of Rajasthan,2018 SCC OnLine Raj 2287, Order dated 13-12-2018]
