DAY 3 [BATTLE ROUND 2: 20th October,2019]

With immense passion and laborious efforts by our delegates, volunteers inclusive of all other Participants, the event comes to a halt. As someone once quoted, “hard work always pays off”, it was a true pleasure to witness the hard work and dedication of every participant in the event. We were honoured to have the respected dignitaries amongst us to cheer and inspire the participants which eventually led to the successful execution of the Moot competition as planned.

Finally the flagship event of our college, the journey which we embarked upon, comes to an end. The Fifth Madhava Menon SAARCLAW Mooting Competition India Round is officially closed. The college is looking forward to host the international round which is to be held in the month of February, 2019.

VALEDICTORY FUNCTION

05:35 PM – The last day of the ceremony proceeded as all the participants and volunteer got their pictures clicked and this how the day ends.

05:30 PM – The teams are having high tea.

05:17 PM – The valedictory session ended with the National Anthem.

05:10 PM – Prof. (Dr.) Md. Salim, Director, Lloyd Law College, is now is giving vote of thanks to all the participating teams, our guests and the OC members. He also throws light upon the work and support given by our Honourable Prof. N. R. Madhava Menon.

05:01 PM – Best Mooter: Sameer Gupta, NLU Ranchi.

04:32 PM – Participation Certificates are being distributed to all the teams.

04:29 PM – Mr. Ravi Prakash, Advocate, Supreme Court of India, has presented the moot proposition to our chief guest.

04:17 PM – Hon’ble Mr. Justice Ajay Kumar Tripathi, Former Chief Justice of Chattisgarh, Member, Judicial Lokpal, is now addressing the audience. He explained and outlined the evolution of legal education in the last 10 years. He continued by highlighting the various scopes one has after choosing law as a career. He emphasized on the legal studies and dignity that a lawyer possesses. He also shared his experiences as a former student of our late Prof. N. R. Madhava Menon.

04:05 PM – Dr. Lalit Bhasin, President, SILF & Bar Association of India, is at the dais. He discussed about the contribution of Prof. N. R. Madhava Menon in the field of legal education in India. He also explained the importance of a teacher despite having all the technologies. “Etiquette is the attire of a lawyer”, he further added.

03:55 PM – Mr. R. Venkatramani, Senior Advocate, Supreme Court Of India/Advisor, SAARCLAW Mooting competition, is on the dais. He described “what a moot problem is and how it is even relevant with real life”. He further continued discussing about importance of ethics in law and advises that every lawyer must follow it.

03:45 PM – Prof. (Dr.) S. Siva Kumar, Professor, ILI, , SAARCLAW mooting administrator is now addressing the gathering. He heart fully thanked everyone to make SAARCLAW Moot court competition possible. He also motivated every student to be a part of such activities and wishes everyone luck.

03:35 PM – Mr. Akhilesh Kumar Khan, Deputy director, Lloyd Law College, is now addressing the audience. He describes the importance of moot court competition in the life of a law student and how SAARCLAW moot court competition has evolved throughout the years.

03:25 PM – Mr. Manohar Thairani, President, Lloyd Law College, is delivering a welcome address. He also thanked SILF and MILAT for holding this mooting competition. He said that the presence of the Chief Guest encouraged us and inspired us. He further thanked all the participants and judges for being a part of the competition.

03:20 PM – All the delegates are heartily welcomed by Mr. Manohar Thairani, President, Lloyd Law College, Prof. (Dr.) Md. Salim, Director, Lloyd Law College, Prof. Akhilesh Kumar Kumar, Deputy Director, Lloyd Law College.

03:18 PM – The chief guests and other dignitaries have arrived

03:17 PM – All the participants are looking super excited for the ceremony to begin, a couple of them are a bit nervous about the results.

03:15 PM – The Chief will be with us in few moments.

03:12 PM – The organizers are ensuring if all the teams are present.

03:10 PM – The valedictory session is about to begin.

03:07 PM – All are looking pretty and are waiting for the Valedictory Session to begin.

03:05 PM – The volunteers are assisting the teams to their seats.

03:00 PM – All the participants have assembled in the Seminar Hall for Valedictory Session.

01:45 PM – Judges are heading towards the reading room for their lunch after which the arrival of guests and group photograph session will take place.

01:42 PM – All the participants along the volunteers and other members present in the college are moving forward for their lunch.

01:42 PM – Finally the pleadings in each courtroom ended for Round 2, Stage 2 which marks end for this year’s “Fifth Prof. N. R. Madhava Menon SAARCLAW Mooting Competition India Round 2019-20”

01:40 PM – After Judges the teams are moving out from their courtrooms with bright jolly faces looking confident.

01:37 PM – The judges are coming out of the Courtrooms.

01:35 PM Score-sheets are collected from the judges now by the court masters and now the judges are leaving from the court room.

01:30 PM – The rounds have been ended in almost all the rooms.

COURT ROOM MC 1

 

01:20 PM – Rebuttals went well and now, the rounds are over.

01:15 PM – Speaker answered all the questions confidently.

01:05 PM – Speaker 2nd has taken over the dais.

12:51 PM – Now the respondent speaker 1 has begun with his pleadings. He is confident and fluent.

12:40 PM – Speaker 2 impresses the judges by his arguments. The judges don’t ask him much questions.

12:13 PM -The judges are asking questions next to next and are satisfied by answer given by counsel 1.

12:06 PM – Now the counsel from petitioner side seeks the permission and has started giving synopsis.

12:04 PM –Judges have arrived and have took their respective seats and we are about begin the pleading.

11:57 PM – The respondents and petitioner have arrived and are waiting for the judges.

01:20 PM Pleadings are over.

01:11 PM Both the teams are done with their pleadings and now it is the time for rebuttals.

12:57 PM Speaker 2 from the respondent side has mentioned about the section 5 of the Indian Evidence Act.

12:40 PM 2nd speaker has ended her part and now it’s time for the respondent . Respondent take permission to approach dais.

12:21 PM Speaker 1 ends his argument by citing various section of NDPS Act . Now speaker 2 approaches towards the dais.

12:09 PM One of the Judge asked about  the restriction of right to privacy.

11:59 PM Judges have also arrived here we can easily see the nervousness on the faces of the participants.

01:17 PM Done with pleadings. Time for rebuttals.

01:05 PM Speaker 2nd is now started pleading.

12:50 PM Respondent’s speaker 1st takes over the case.

12:33 PM The co-counsel came on dais. He seems to be struggling from questions thrown by judges, the answers do not seem to impress the judges.

12:17 PM Speaker 1 from petitioner side started confidently despite judges asking questions continuously he was able to answer them flawlessly.

12:04 PM Judges have arrived. The proceeding is about to begin.

01:28 PM Rebuttals went well. Done for the day. Rounds are over.

01:20 PM Time for rebuttals.

01:10 PM Speaker 2nd has come on the dais.

12:55 PM The respondent side comes with the first speaker.

12:33 PM The co-counsel gets up the podium.

12:08 PM The judges are throwing bunch of questions but the counsel is helping each other and making it a head to toe good execution.

01:08 PM – Speaker 2nd has completed his pleadings. Time for rebuttals.

12:53 PM Speaker 2nd has come on dais.

12:47 PM Speaker 1 is done. Now, speaker 1st from the respondent side came to plead and has mentioned about the section 5 of the Indian Evidence Act.

12:36 PM The Petitioner speaker 2 starts his pleading while judges reminds them to use their allotted time.

12:28 PM The Petitioner speaker 1 tries her best to satisfy the judges.

12:07 PM The Petitioner speaker 1 comes to the dais and with a medium tone she starts presenting the facts .

10:55 AM – Rounds are over.

10:45 AM – Rebuttal round started.

10:41 AM – The second counsel is showered with questions but the judges are looking satisfied with the answers given by him.

10:25 AM – The second counsel on behalf of respondent seeks permission and approaches the podium.

10:23 AM –The judges are asking questions which the counsel is trying to answer confidently.

10:13 AM – The first counsel of the respondent seeks permission to come to the dais and permission of the same is granted.

10:12 AM – The second counsel finishes his pleading.

10:07 AM – Only five minutes left for the second counsel.

09:52 AM – The second counsel of the petitioner side seeks permission and comes to the podium with enthusiasm.

09:35 AM – The court is in session and asked to maintain the decorum of the court.

09:36 AM – The counsel from the petitioner side takes permission and starts with his pleading.

09:33 AM – The judges have arrived.

09:32 AM – The teams are flipping the pages and arranging the documents also. They are looking quite nervous.

09:25 AM – The teams have arrived and waiting for the judges to come to the respective court room.

11:12 AM: Rounds are over.

11:02 AM : Rebuttals have started.

10:43 AM: Respondent 2nd is now waiting for his turn.

10:19 AM: Respondent 1 proceeds with the pleading.

10:16 AM: Extra time given by judges to co-counsel still hasn’t finished her pleadings.

10:14 AM: Time is over for petitioner side.

10:04 AM: Judges start asking questions to co-counsel of petitioner side and she is very confidently answering the questions.

10:00 AM :speaker 1 of petitioner side over his pleading speaker 2 started her pleading.

09:35 AM – Judges are asking questions to the speaker and speaker confidently give the answer.

09:32 AM: Speaker 1 from the petitioners side starts the pleading.

11:05 A.M.- Rounds are over and the judges hand over the score sheets to the court masters.

11:01 A.M.-  speaker 2 in an energetic way starts rebuttal from the petitioner side clarifying and answering questions which are left to them by respondent.

10:57 A.M. – the rebuttal round begins.

10:55 A.M.- the teams concluded and seeks the permission for prayer.

10:40 A.M.- respondent speaker 2 seeks permission from judges. He is nervous.

10:11 A.M– respondent speaker 1 seeks permission. She is a good orator.

09:47 A.M.- speaker 2 seeks permission and starts the pleading with confidence and fluency.

09:40 A.M. speaker 1 from petitioner side impressed judges with her arguments. She also satisfied the judges with her answers of the questions raised by the judges.

09:30 A.M –petitioner speaker 1 starts with the pleading. She starts in a poised and calm manner.

09:25 A.M.- the teams have arrived and judges also and we are to begin with pleading.

11:17 AM – Rebuttals and rounds both are over finally.

11:06 AM – Time for rebuttals.

10:56 AM – Respondent’s speaker 2 came to the dais and started arguing fluently.

10:33 AM – The Respondent’s speaker 1 comes to the dais and he started presenting facts in a confident way.

10:47 AM Time for the 2nd speaker to plead.

10:45 AM There is a complete silence from the respondent after the judges asked the question .

10:17 AM Now it’s the turn of respondent . He started their pleading by attacking the Petitioner by citing article 32 and Said that it was not a case of violation of fundamental right .

10:15 AM Petitioner forget to do the final prayer. After getting reminded by the judges the Petitioner finished their final prayer

10:13 AM Petitioner failed to answer the questions .

10:11 AM Judges questioned that in the judgement of puttaswamy right to privacy was progressive in nature please explain the scope and limit of fundamental right .

10:07 AM The Petitioner started citing many case law of right to privacy , and exploitation of children . And speaker is continuously trying to prove that there was a breach of privacy

10:01 AM Now it’s the turn for the 2nd speaker . She also approached the dais by citing the judgement of puttaswamy and saying that right to privacy is a fundamental right under article 21 of the Indian constitution

09:58 AM Time is over now but still the judge provided extra time to the 1st speaker of the Petitioner because she was in a confused state and she was trying to answer the questions in which she lastly failed .

09:50 AM Judges are continuously questioning the Petitioner about the maintainability of the writ and for the breach of privacy but the Petitioner is enable to answer any of their questions.

09:44 AM There was a great silence from the Petitioner side they were having no answer when the judge said ” You should have approached juvenile court first for this case ”

09:43 AM – One of the Judge questioned that can the police search a school without search warrant?

09:40 AM – Petitioner said that she as filed the petition under  section 32 of the Constitution cause there was a case of infringement of fundamental right.

09:33  AM Petitioners have started their pleading by citing the landmark judgment of puttaswamy and said that her writ is maintainable.

09:27 AM Judges have arrived . There is a clear picture of nervousness on the faces of the participants.

11:20 AM Rounds are over. Teams have left the courtroom.

11:11 AM Looks like the petitioner speaker have noted down their answers while the Respondent was alleging them. Petitioner speaker sticked to her submissions and concludes.

10:57 AM speaker 2 from respondent side is being showered with the questions and he is unable to answer them

10:53 AM The Speaker 2 continues to explain the facts of the case

10:49 AM The respondent’s speaker 2 takes over the dais and start describing the facts of the arguments.

10:39 AM Speaker is presenting his arguments. judges are also cross questioning him, the bench made the speaker quite confused with their questions.

10:20 AM – time over but the petitioner asked for extra 2 minutes.

DAY 2 [BATTLE ROUND 1: 20th October 2019]

Maybe it’s an end of the day but not the competition. We’ll pick up right from here tomorrow again.

07:25 PM – All the teams have been departed from the College.

07:00 PM -The Judges headed towards the reading room for High tea.

06:55 PM – The participants after the mooting session, headed towards the lawn for High tea.

06:50 PM – And finally the pleadings finished and the judges are discussing the time with the court masters and giving the marks for the teams and given the score sheets to the court masters and leaving the courtroom.

06:00 PM – Rebuttals have started and wrapped up in no time. Rounds are over.
05:58 PM – Respondent rests the case.
05:43 PM – Now, speaker 2nd of the respondent has started pleading.

05:30 PM – Adv. Joseph Aristotle S is questioning the speaker 1st for the respondent and he is answered with full confidence.

05:25 PM – Petitioner rests the case.

04:48 PM – Judge interrupted the speaker to throw a question and he answered confidently.

Being the Judge of the Supreme Court, she expresses her views on the legal profession and stresses about the ‘will of fire‘ which is present in every individual’s soul. She further adds that the ‘will‘ is the thing which encourages good deeds and morale in an individual.

11:33 AM – Prof. (Dr.) V. Vijayakumar, Vice-Chancellor, National Law Institute University, Bhopal, address the students by sharing his law school experiences and his educational journey. He further shares the delightful journey of his career as he began it with Prof. N.R. Madhava Menon. He also describes the law as a culture and we all should maintain and respect its dignity.

Venkataramani, Senior Advocate, Supreme Court of India, Advisor, SAARCLAW Mooting Competition, approaches the dais and enlighten us by quoting “the canvas which is blank but it is us, who would complete it“. He further adds by a beautiful saying that “Students are the beautiful fabric of law which makes it whole” in which he address the law aspirants.”

As many as 46 law schools have registered for the Indian Rounds, where the 7 qualifying teams will further battle in the SAARC Round with teams from SAARC Countries.

NAMING THE COMPETITION-

Prof. (Dr.) N.R. Madhava Menon is known for the reform brought about in Indian legal education by the pioneering efforts n the last three decades by introducing Five Year Integrated B.A.LL.B. programme under the National Law School experiment is the inspiration for Lloyd Law College sponsoring the Mooting Competition in his name. Lloyd Law College is proud to be associated with MILAT and Society of Indian Law Firms (SILF) is launching the Mooting event for the benefit of law students of South Asian countries.

Fifth Prof. N. R. Madhava Menon SAARC Mooting Competition, Law Students’ Conference & Judges Colloquium 2019 is to be organized by Lloyd Law College under technical support from MILAT-Menon Institute of Legal Advocacy, Trivandrum and Society of Indian Law Firms (SILF) at Lloyd Law College, Greater Noida, Uttar Pradesh, India. There are two stages of the competition. this round is the Indian round of the same. the two rounds are The Indian Round and the SAARC Round for India, Pakistan, Sri Lanka, Bangladesh, Afghanistan, Bhutan, Nepal and Maldives. India Round is here in witnessing 46 teams from the best of all the law schools in India.
