Delhi High Court: In a case filed by a student of class XIIth who is under a dilemma of whether to give CBSE improvement exams or CUET (UG) 2022 as there is a date clash, Sanjeev Narula, J., binds the National Testing Agency ‘(NTA') accountable to consider the case of the petitioner-student in view of its public notice dated 22-08-2022 wherein NTA assured to reconsider and reschedule such similarly placed candidates.
The petitioner is appearing for class XIIth CBSE improvement of performance examination for the subject of Mathematics. The instant petition was filed seeking a direction to Respondent 2-National Testing Agency to reschedule his Common University Entrance Test [CUET (UG) 2022] examination from 23-08-2022 to any other subsequent date on the ground of conflict in dates of the said two examinations.
Counsel for NTA informed the Court, that a public notice dated 22-08-2022 was issued by the NTA to accommodate students who are similarly placed as the Petitioner. The notice states
NTA has now received requests from candidates to re-schedule their examinations scheduled on 23-08-2022, in view of other examinations like CBSE compartment exam beginning from 23-08-2022.
In view of the above, it has been decided to consider such requests favorably. NTA has also created an exclusive grievance redressal e-mail for this purpose. The grievances of candidates regarding re-scheduling of their tests in view of CBSE Compartment exam should be sent to cuetug-dateclash@nta.ac.in.
Candidates must mention their Application Number in their email while sending their grievances. Digitally Signed
The fresh dates will be communicated to the affected candidates through their Admit Cards and Public Notice.
The Court thus clarified that as Petitioner has already raised his grievance with the NTA, he shall be entitled to benefit under the public notice dated 22-08-2022.
