Kerala High Court: In a writ petition filed seeking the issuance of an economically weaker section (EWS) certificate, V.G. Arun, J. allowed a provisional certificate to be issued to the petitioner.
The government pleader contended that, if the family of the applicant owns more than 20 cents of ‘house plot’ within the Municipal Corporation area, the applicant will not be entitled for EWS certificate.
The Court was of the view that even though the family of the petitioner owns lands, the petitioner is a married woman who lives separately, and this prima facie cannot be a reason for denying her an EWS certificate.
The Court directed the State to issue a provisional EWS certificate to the petitioner, subject to the final outcome of the present writ petition.
