Ministry of Road Transport and Highways 

On 27-3-2023, the Ministry of Road Transport and Highways notified the Central Motor Vehicles (Second Amendment) Rules, 2023 to amend the Central Motor Vehicles Rules, 1989. The provisions came into effect on 27-3-2023.

Key Points:

  1. Rule 115 relating to “Emission of smoke, vapour, etc. from motor vehicles” has been revised:

    115 (18) (I) (Notes) (Para 19)

    During type approval and COP applicable from 1-4-2020, real world driving cycle emission measurement using PEMS shall be carried out for data collection and from 1-4-2023 real world driving cycle emission conformity shall be applicable. The detailed procedure is laid down in AIS137 and as amended from time to time.

    115 (18) (I) (Notes) (Para 19) (a)

    During type approval and COP applicable from 1-4-2020, real world driving cycle emission measurement using PEMS shall be carried out for data collection and for vehicles of category M and N having gross vehicle weight not exceeding 3500 kgs, manufactured on or after 1-4-2023, for all models, during real world driving cycle emission measurement using PEMS, Conformity factor shall be applicable as per the procedure laid down in AIS 137 and as amended from time to time.

    Rule 115 (18) (I) (Notes) (Para 19) (b)

    has been inserted which lays down the Table of Conformity Factor (CF) that needs to be followed during the type of approval.

  2. The table elaborating “Maximum Allowed Conformity Factors (CF) for in-service Conformity Emission Testing” has also been inserted:
