Supreme Court: In a resolution passed on 28-03-2023, the Supreme Court collegium headed by Dhananjaya Y. Chandrachud, C.J., Sanjay Kishan Kaul, K.M. Joseph, M.R. Shah, Ajay Rastogi, J.J. recommended the transfer of Justice Atul Sreedharan to the High Court of Jammu & Kashmir and Ladakh.
He had requested the Supreme Court Collegium to transfer him out of the Madhya Pradesh High Court since his elder daughter would be entering law practice in the same High Court next year. The Collegium in turn acceded to his request and recommended that he be transferred to the Jammu and Kashmir High Court.
Further, the Supreme Court Collegium accepted the transfer request of Justice Sanjeev Prakash Sharma from High Court of Judicature at Patna to High Court of Punjab and Haryana.
He had sought repatriation to the Rajasthan High Court being his parent High Court on the ground, inter alia, of his poor health and unavailability of adequate medical facilities at Patna. He had informally requested that if his repatriation to the Rajasthan High Court was not possible, he would seek a transfer to the High Court of Punjab and Haryana in view of the nature of the medical facilities available at Chandigarh to facilitate treatment of his condition.
The Collegium acceded to his request and recommended that he be transferred to High Court of Punjab and Haryana.
However, the Collegium rejected the transfer request of Justice VM Velumani to a High Court of the North-Eastern States, preferably Manipur or Tripura and reiterated its previous recommendation of transferring her from the Madras High Court to the Calcutta High Court for the better administration of justice.
She sought a transfer to a High Court of the North-eastern States, preferably Manipur or Tripura, on the ground that she would then be able to retain her official accommodation at Chennai.
The Collegium had first recommended her transfer to Calcutta High Court in its resolution dated 29-09-2022. However, she sought a reconsideration of the same by a letter dated 14-10-2022. But the Collegium rejected her request for reconsideration, and through a resolution dated 24-11-2022 reiterated the recommendation for her transfer. She wrote to the Supreme Court Collegium once again in 17-03-2023 seeking to be transferred to a High Court of the north-eastern States, preferably Manipur or Tripura. However, the Collegium rejected it saying there was no valid reason for allowing the same.
